{"id":1999,"date":"2015-07-28T15:07:43","date_gmt":"2015-07-28T19:07:43","guid":{"rendered":"https:\/\/aia.harnessip.com\/?p=1999"},"modified":"2015-07-31T16:26:12","modified_gmt":"2015-07-31T20:26:12","slug":"thats-not-what-theyre-for","status":"publish","type":"post","link":"https:\/\/aia.harnessip.com\/?p=1999","title":{"rendered":"That&#8217;s Not What They&#8217;re For"},"content":{"rendered":"<p>On July 28, 2015, the patent owner in\u00a0<em>Coalition for Affordable Drugs VI LLC v Celgene Corporation<\/em>, IPR2015-01103, filed a motion for\u00a0sanctions pursuant to\u00a035 USC \u00a7316(a)(6) and 37 CFR \u00a742.12, arguing that petitioner was misusing inter partes review to manipulate patent owners share prices, and that their petitions &#8220;represent an ongoing abuse of the IPR process.&#8221;<\/p>\n<p>The Motion complains that the petitions are\u00a0driven entirely by an admitted \u201cprofit motive\u201d unrelated to the purpose of the American Invents Act (\u201cAIA\u201d), as set forth in the bill itself and its legislative history, and unrelated to any competitive interest in the validity of the challenged patents.\u00a0 But when a competitor is challenges a patent, it too is motivated by profit &#8212; the profit from making and selling a product.
