A.S. v. Rohm And Haas Company<\/em>, IPR2014-00185, Paper 42 (December 18, 2014),\u00a0the\u00a0Patent Owner\u00a0was denied permission to file a motion to compel the deposition of the declarant in a declaration submitted by the Petitioner\u00a0in opposition to the Motion to Amend.\u00a0 The Declaration was from a separate ITC proceeding between the parties, so the\u00a0Board agreed that the deposition was not Routine Discovery under 37 C.F.R. \u00a7 42.51(b)(1)(ii).\u00a0 However, the Board cautioned petitioner that\u00a0the Declaration\u00a0&#8220;may be entitled to little or no weight, as it has not been subject to cross-examination as it pertains to the instant proceeding.&#8221;\u00a0 The Board then sent the parties off to work things out, instructing the Patent Owner to renew the motion if agreement is not reached.<\/p>\n<p>.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>In Organik Kimya San. ve Tic.
